High Court Commercial Disputes 2021
Solomonic’s Year in Review 2021 is now available
Solomonic, as the UK’s most comprehensive commercial litigation database, has compiled a review of the 2021 year in commercial litigation in the High Court.
The report reveals new insights into the second year of the pandemic and how it played out in terms of new commercial disputes.
2021 proved to be another busy year, the first of the “new normal”, with some long-heralded areas of dispute coming to the fore, most notably in data protection and the diesel-gate scandal. The turbulent economy created meaningful economic stress and consequent commercial litigation across a range of topics and sectors.
Overall, 1,500 law firms were instructed in over 5,000 new disputes in the year.
Key highlights from our analysis include:
Professional negligence disputes were on the rise and professional services was the most active sector with disputes up 12%.
Public sector claims rose by 136%, fuelled in part by a sharp jump in public procurement issues.
The collapse of dozens of energy firms amidst rising energy costs saw OFGEM issue the most new claims last year of any party.
Covid related disputes, widely expected to rise as the impact of the pandemic gives rise to litigation, saw a decrease. Perhaps signalling the lull before the storm?
